The petitioners argued that the mining operations encroached upon the Mt. During the 3rd Governance of the Committee (GOC) meeting on May 31, 2023, a complaint regarding coal mining activities was raised. The PH-EITI Secretariat shared the discussion that took place during the meeting with PMPI. In this meeting, the Department of Energy (DOE) provided a brief description of the San Miguel mining projects in Lake Sebu, South Cotabato, stating that they had recently commenced. It was revealed that the company had waited for endorsement from the Sangguniang Panlalawigan for the past 10 years before being able to operate fully. Reports on geohazards in the area had been submitted by the Mines and Geosciences Bureau (MGB) prior to the commencement of mining operations. The Department of Environment and Natural Resources (DENR) had issued an Environmental Compliance Certificate (ECC) to the company. Additionally, the company and DOE had a discussion with Reverend Cerilio Casicas of the Diocese of Marbel on April 12, 2023, regarding the coal mining activities.

The GOC agreed to wait for a direct complaint letter from PMPI, which would then be endorsed to the DOE. Once the official complaint letter is received, the DOE will provide the requested documents to PMPI.

The PH-EITI Secretariat has reviewed the records of SRMI’s IP royalty payments in the ORE tool. The 2021 data reveals that SRMI has made the required IP royalty payments. Moreover, several of the Datus listed to receive the 2021 royalty payments are named in the resolution signed by IP leaders from SRMI’s host communities.

The PH-EITI Secretariat is currently in communication with Bantay Kita to clarify the total amount outstanding from SRMI. Further details are also being sought regarding the specific payment arrangement agreed upon between SRMI and the IP communities for these royalty payments. Once these clarifications are obtained, the PH-EITI Secretariat will engage with other relevant agencies to properly address this issue.

The Secretariat received correspondence from NCIP regarding the matter. NCIP’s Ancestral Domains Office referred the matter to Regional Director Atty. Geroncio Aguio of NCIP Region XI. Atty. Aguio reported that their regional office has sent communication letters to the DENR-LMS of Region XI and the LRA-ROD Region XI. Additionally, a letter was dispatched to the NCIP Davao de Oro Provincial Office for verification of the facts concerning Lot 3809. Atty. Aguio assured that their office will continuously cooperate and assist in resolving the issue and will keep us updated on any correspondence received from the contacted agencies.

MSG members offered to follow up with senior officials from the Department of Environment and Natural Resources (DENR) and National Commission on Indigenous People (NCIP). The group noted that while YMC cited an ATVM, IPRA requires certification preconditions and FPIC before exploration and recommended that government lawyers provide a definitive interpretation. MSG members suggested that the community explore legal remedies such as a Writ of Kalikasan and offered to connect them with legal aid organisations. PH‑EITI committed to monitor the case, share information within the MSG, and incorporate transparency around exploration and reclamation projects into its governance agenda. This case highlights broader governance issues – the absence of FPIC and certification preconditions before exploration, contradictory interpretations of the law, opaque and inconsistent permitting practices, weak monitoring by regulatory agencies, and potential intimidation and undue influence in the consultation process. Community mobilisation, a pastoral statement from the local diocese and a congressional inquiry demonstrate the growing demand for accountability. As of January 2026, the FPIC process remains contested, heavy equipment has been sighted despite the cease order, and there is still no confirmed approval for YMC’s exploration permit
